Section 1: Seller Obligations

This puppy is a pure bred___________________registered with AKC, CKC, ACA, APRI, or is registerable with CKC six months. Upon execution of this contract, the seller does hereby convey title and interest in the described (_________________________) puppy to the buyer(except for the terms listed herein). Sweesy's chihuahua's has made every effort to provide you with a healthy puppy. Breeder guarantees that all vaccinations and worming are current. At the time of sale, this puppy/adult is considered to be ** PET QUALITY**. Sweesy's chihuahua's offers no guarantee that this puppy not have disqualifying faults now or will not arise at a later date, witch would make this puppy unsuitable for the show ring or for breeding purposes. It is the buyer's responsibility to have this puppy examined be a licensed veterinarian of their choice within 48 hours of taking possession of this puppy/adult. If the sale transaction takes place of friday and monday is a holiday the buyer will be given an additional 24 hours to have a licensed veterinarian to examine the puppy. If this puppy is found to have a life threatening congenital defect or health problem at this exam, a replacement puppy of equal value will be given if available and the buyer wonts another puppy, if there is not a puppy available or the buyer dose not wont another puppy then one will not be given but if so a nother puppy from a next available litter will be given, provided the breeder is contacted immediately ( within 24 hours ) after the exam, and this puppy is promptly returned to sweesy's chihuahua's, at no expense to the breeder, with a signed document from the veterinarian stating the defect or problem . Registration papers given at the time of sale must accompany the returned puppy to sweesy's chihuahua's . pending verification by the breeder's veterinarin .Sweesy's chihuahua's will not be responsible for illness or health problems , witch are diagnosed after this time period, except ,were stated in this contract. ***BREEDER*** will not be responsible for Parvo, Distemper or Corona virus after 48 hours of sale, as these are such highly contagious diseases and they can be contracted immediately after leaving the breeder. breeder further guarantees this puppy for 6 months (from date of birth) against life threatening congenital defects. If within that time a life threatening congenital defect is found, breeder will replace this puppy with another one of the same breed,quality and sex and price. The replacement will be subject to availability ( within approximately 8 months). The puppy will be replaced , no moneys will be refunded. Sweesy's chihuahua's will not be responsible for illness or health probloms, witch are diagnosed after this time period. In the unlikely event of this puppy's death in the first 6 months , due to a congenital defect, a statement from a veterinarin confirming such an event and cause is required befor the breeder will take any action. If cause is unknown, an autopsy is required. ****Under no circumstances will the breeder be responsible for veterinary or medical bills incurred.

SECTION II: BUYERS OBLIGATIONS
Buyer swears that he/she is not acting as an agent in the purchase of this animal and that it will remain solely in his/her custody. Buyer further swears that he/she is not associated with a pet shop or animal broker. The buyer agrees to care for this dog as would a humane and conscientious dog owner and agrees to provide:
1.) To confine the dog when outdoors and refrain from restraining it on a chain or rope accept when under the direct supervision of the buyer. EX:leash walking
2.) To provide proper veterinary care is given immediately, including but not limited to injuries,illness, and annual check ups, keeping all immunization current according to the American Veterinary Medical Association Guidelines and kept on heartworm preventive as per veterinarian instructions.
3.) Adequate housing for this dog within the buyers home and yard.
4.) Adequate exercise by providing the dog with supervised walking and running on a regular basis.
5.) Safe vehicle transport. The buyer must not at any time transport the animal in the open cargo area of a vehicle . EX: back of pickup truck( can not be tide or lose must be in an crate or pen).
6.) Feed the dog a good quality pet food. Instructions for feeding given by the breeder.
7.) All expenses regarding the animal incliding : shipping the animal, proper care, veterinary fees, housing or legal libilities are the responsiblity of the buyer at whose home the animal will reside.
8.) the buyer agrees to inform SWEESY'S CHIHUAHUA'S of any titles or awards obtained by the animal for our breeding records.

****The breeder will accept the return of this dog at any time the purchaser declines to keep said dog. How ever, the breeder is not obligated to refund any or the entire purchase price except as stated in the conditions above. ***Violations of the terms of this contract renders all guarantees stipulated in this contract to be null and void and may result in the buyer being required to return the dog to the breeder within five days of this notice from the breeder. The buyer will be responsible for the cost of the dog's transport back to the breeder. If the buyer violates this agreement, he/she will be responsible for any/all legal cost the breeder acquiers enforcing in this contract. ***This contract is valid for this original purchaser that purchased the dog from sweesy's chihuahua's. If the dog is transferred to another owner this contract is null and void, as breeder hase no way of knowing how the dog is cared for or to whom the puppy/adult would be placed with.

PAYMENT AGREEMENT CONTRACT

THE FOLLOWING AGREEMENT IS BETWEEN:HOLLY SWEESY, HEREAFTER KNOWNE AS"SELLER",AND________________,HEREAFTER KNOWN AS "PURCHASER".

2) IF A PAYMENT CAN NOT BE MADE ON SAID DATE THEN SELLER MUST BE NOTAFIDE AT LEAST A WEEK PRIER TO PAYMENT DUE DATE!

3) IF FOR ANY RESON YOU ARE NOT ABLE TO PAY FOR THE PUPPY ANY MORE. SELLER IS TO BE NOTAFIDE BEFOR NEXT PAYMENT IS DUE . IF NOTAFIDE AFTER PAYMENT IS DUE AND NO PAYMENT IS RECEVED WITH IN 24 HOURS OF DUE DATE THEN NO MONEY WILL BE REFUNDED!

I WILL ALSO REQUIRE A BRUCELLOSIS TEST THE TEST MUST BE NEGATIVE, OTHERWISE I WILL NOT BREED TO YOUR FEMALE.YOUR FEMALE MUST BE UP TO DATE ON HER SHOTS.

WE DO NOT GUARANTEE THE SIZE AND COLOR OF THE LITTER YOUR FEMALE WILL HAVE. ALL OF MY STUDS ARE PROVEN,SO IF THE FEMALE DOES NOT TAKE OR GET PREGNANT THEN THERE MAY BE SOMETHING WRONG WITH HER. WE ALSO DO NOT GUARANTEE THAT ALL OF THE PUPPIES WILL BE BORN ALIVE.SOME PUPPIES DO NOT MAKE IT DUE TO BIRTH DEFECT,OR THE MOTHER WILL NOT RECOGNIZE THE PUPPY, OR, PUPPIES.

I WILL BOARD YOUR FEMALE HERE ON MY PROPERTY FOR THE WEEK SHE IS IN BREEDING HEAT. I WILL NOT BE RESPONSIBLE FOR THE FEMALE IF SHE GETS HURT OR SHE DIES. I WILL SEEK MEDICAL ATTENTION FOR HER IF AN EMERGENCY ARISES YOU WILL BE RESPONSIBLE FOR THE VET BILL IN THIS CASE. YOU CAN LEAVE HER AT YOUR OWN RISK. PLEASE REMEMBER THAT WE ARE DEALING WITH ANIMALS AND FOR ANY REASON AT ALL THEY MAY DECIDE GET INTO A FIGHT WITH THE MALE CHOSEN FOR HER TO BREED WITH.IF THIS DOSE HAPPEN THEN YOU WILL BE NOTIFIED IMMEDIATELY AND ASKED TO COME AND GET YOUR FEMALE FOR HER AND MY DOGS SAFETY. FOR THESE REASONS I WILL NOT BE RESPONSIBLE FOR HER.I HOPE THIS WILL NOT HAPPEN AS I TAKE EVERY POSSIBLE PRECAUTION TO MAKE SHUER THAT THIS WILL NOT HAPPEN. ALL FEMALES BROUGHT TO MY HOUSE TO BE BREED WILL BE KEPT IN SIDE AT ALL TIMES AND WILL NEVER COME IN CONTACT WITH ANY OF MY OTHER DOGS EXCEPT FOR THE MALE THAT SHE IS TO BE BREED WITH. SHE WILL BE KEPT IN A PLAY PEN AT NIGHT AND A BREEDING KENNEL DURING THE DAY. I WILL NOT ACCEPT A FEMALE HERE WHO BITS,OR FIGHTS WITH OTHER DOGS, AS FOR THE SAFETY OF MY DOGS AND ME AND THE PEOPLE THAT WILL BE TENDING TO THE DOGS.

MY BOARDING FEE IS $25 DOLLARS A WEEK. IF THERE IS ANY SPECIAL FOOD YOU WANT YOUR FEMALE TO EAT WHILE SHE IS HERE THEN PLEASE BRING IT WITH HER AND ANY FEEDING INSTRUCTIONS FOR HER.
I DO NOT GIVE A REFUND IF YOUR FEMALE DOES NOT GET PREGNANT. I WILL RE-BREED HER FOR YOU AT NO CHARGE.

WE ARE NOT RESPONSIBLE FOR ANY VETERINARIAN COSTS THAT YOUR FEMALE AND THE PUPPIES WILL NEED. THIS INCLUDES BUT NOT LIMITED TOO X-RAYS, SHOTS,A C-SECTION,WORMING,OR ANY THING ELSE THEY MAY REQUIRE.
